Ile Tuntun Customary Court, Mapo, Ibadan, Oyo State, has dissolved the eight-year-old union between Oyeronke Kolapo and Olalekan Kolapo, over battery and neglect.
Oyeronke, a trader had approached the court, stating that her husband was heartless, brutal and nonchalant about her well-being and that of their children.
She, therefore, sought for a divorce and custody of their two children.
“My lord, it is better to be a widow than have a husband who is useless and worthless, the plaintiff told the court.
“I have lost count of the number of times my children and I went to bed hungry all because of my husband’s uncaring attitude.
“He’s not bothered if the children eat or not. He also doesn’t care if they go to school or put on decent clothes.
“If I complain, he will turn it into a fight. There were times he beat me till I was unconscious. Thank God for neighbours who were around at such instances to pour water on me to revive me.
“I have spent all the proceeds from my trade in running the home. This automatically took its toll on my business which today has folded up.
“I want to live long and be there for my children. If I remain under my husband’s roof, he will kill me and my children will suffer.
“I, therefore, plead for the dissolution of our marriage and custody of our children so that I can take good care of them, she concluded.
Olalekan, denied all his wife had said.
“My lord, my wife is a pathological liar, “he said.
“She has cooked up all those stories to save her face and whip up sympathy before the court.
“My wife is quarrelsome. She fights not only me but our neighbours also.
“She has no regard for me. She actually derives pleasure in humiliating me before our children, relatives and friends, “Olalekan added.
“My wife is in the habit of coming home late. She doesn’t come home earlier than 9:00 pm when the children must have slept. Since I can’t watch my children go to bed hungry, I took it as my responsibility to prepare them dinner.
“Making love to my wife is a tug of war. She satisfies her lust outside and denies me sex. And even when she gives in, she will lay still and cold in bed making me feel I’m making love to a corpse.
“She also doesn’t have regard for my parents, and has been rude especially to my mother in my presence on several occasions.
‘I have reported her to her parents, but she has failed to change.
“She packed out of our home in January and came back one afternoon, broke my door and gained access into my apartment. She ransacked my room and went away with my money.
“I’m also tired of living with a thief and a slot. I, therefore, agree to our being separated, he told the court.
The court president, Chief Agbaje Olasunkanmi, having listened to the two, noted that there was no more harmony in their home while the love between them had waned.
According to him, “their marriage has broken down irreconcilably.” He, therefore, ruled that their marriage be dissolved and granted custody of the children to the plaintiff.
He ordered the defendant to give the plaintiff N5,000 monthly as the children’s feeding allowance and this he stated must take effect from March 1.
The defendant was also instructed to be responsible for the children’s education and healthcare.
