In a surprise move, Justice Binta Nyako has recused herself from the trial of Nnamdi Kanu, leader of the Indigenous People of Biafra (IPOB), at the Federal High Court in Abuja.
The decision was announced during the resumed hearing of the case on Tuesday, sparking intense interest and speculation.

Nnamdi Kanu is facing charges related to treasonable felony, terrorism, and illegal importation of broadcasting equipment. His trial has been marred by controversy, with IPOB and human rights groups raising concerns about his detention and the fairness of the proceedings.
Although Justice Nyako did not explicitly state the reasons for her recusal, there have been previous calls for her to step down. IPOB had demanded that she recuse herself due to alleged bias, specifically mentioning her husband’s ethnicity.
Additionally, activist Deji Adeyanju had also called for her to step down, citing concerns about her impartiality.
She made the decision after Kanu asked her to rescue herself from his case since she had refused to obey the Supreme Court’s order, adding that he had lost confidence in the court.
“My lord, I have no confidence in this court any more, and I ask you to recuse yourself because you did not abide by the decision of the Supreme Court.
“I can understand it if the DSS refuses to obey a court order, but for this court to refuse to obey an order of the Supreme Court is regrettable.
“I am asking you to recuse yourself from this case,” Kanu had pleaded.
In her response, Justice Nyako obliged by the IPOB’s request on the ground that new judge will be assigned to the case.
IPOB’s lawyer, Ifeanyi Ejiofor, welcomed Justice Nyako’s decision, stating that it was a “step in the right direction.” Ejiofor had previously filed an application for Justice Nyako’s recusal.
The Nigerian government has not commented on the development.
Justice Nyako’s recusal raises questions about the future of Kanu’s trial.
Kanu’s lawyers may seek to revisit previous rulings, including the rejection of his bail application.
