THE Jigawa state higher court sitting in has stopped the Jigawa State Independent Electoral Commission (JISEC) from conducting a bye-election for councilor of Gwaram ward in Gwaram Local Government Area in the state.
This was contained in an order for interim injunctions from the court following the complaint filed by the People’s Democratic Party (PDP) asking the court to bar the state’s electoral body on the allege breaching some Electoral law of the state and country.
According to the order paper obtained by Online Tribune in the state revealed that “an order of interim injunctions restraining the dependent from conducting bye-election for councillorship of Gwaram ward, Gwaram local government, JIgawa state slated to take place on 5th day of August 2023 pending the hearing and determination of motion on notice dated 2nd day of August 2023 already filed before this honourable court is here by granted”.
The court fixed 10 of this month for sharing the case.
When contacted the counsel for the plaintiff in his mobile telephone, barrister AG Wakil said “the councillor representing the Gwaram ward died and the state independent electoral commission fixed tomorrow (5th August) as a day to conduct the bye-election”.
Mr Wakil maintained that “we (PDP) resolved to participate in the election. We went to the electoral body to purchase a nomination form and we were denied the nomination form”.
“This unconstitutional, breached of electoral law and violation guiding principles of election rule and regulations”.
Also contacted the public relation officer of the JIgawa state independent electoral commission (JISEC), Mr Habibu Yusif Babura in his mobile telephone denied knowledge on any court order.
Mr Habibu Yusif Babura noted that “we are not aware of any court order as we never be notified officially. So the commission will conduct the bye-election”.
