A Sharia Court sitting at Magajin Gari, Kaduna State on Wednesday refused to grant full custody of a three-year-old baby to his father, Muntari Ibrahim, 42.
Ibrahim, who resides in Hayin Dan Mani area of Kaduna, prayed the court to grant him full custody of the boy and also urged the court to caution his former wife Amina Sulaiman, 32 against causing trouble in his new home.
Specifically, Ibrahim alleged that Sulaiman was incapable of training the boy.
The Judge, Malam Murtala Nasir, in a ruling held that the right for custody was with the mother in Islamic law.
“Except if she remarries, relocate to another place or has some bad character that might affect the child’s upbringing,” he stated.
Nasir dismissed the case for lacking in proof.
Earlier, Sulaiman, who resides at Rafin Guza area of Kaduna, denied the accusations.
She prayed the court to grant her custody of her son until he reaches a mature age.
