Court orders Ogun govt to maintain statusquo on Daniel’s property

A High Court 3 sitting in Ijebu-Ode, on Monday, ordered the Ogun State Government, to maintain Statusquo on DAKTEM Plaza,property owned by the wife of former governor of the state, Chief (Mrs) Olufunke Daniel, pending the determination of the court on the matter.

The court presided over by Justice N.O Durojaye, said the court had considered the application filed before it by DAKTEM Enterprises Limited through P.A.G.E Law firm, directed parties in the case to maintain statusquo on the property.

Justice Durojaye directed that the originating process and all other processes be served on the defendants within 24 hours.

He, therefore, adjourned hearing on the motion for interlocutory injunction till 27th September.

The defendants in the matter were the Ogun State Governor; Attorney General of Ogun State; Ogun State Planning and Development Permit Authority and the Ogun State Commissioner for Physical Planning and Urban Development.

The applicant represented by Mr. A.M Kotoye SAN,  had filed a motion exparte order of the court restraining the defendants and its agents/allies among others from demolishing the property located on No 62, Ijebu-Ode/Ibadan road, in Ijebu-Ode, pending the determination of the motion on notice.

The applicant also asked for order directing parties herein to maintain statusquo.

Tribune Online recalls that agents of the Ogun State Government, on Sunday morning, destroyed some sections of the five storey building, saying that the Plaza is an illegal structure.

The state government in a statement signed by the Permanent Secretary, Ministry of Physical Planning and Urban Development, Engr. Olayiwola Abiodun, said the structure contravened the Ogun physical planning laws.

He said further that the structure had no approved plan, adding that the said structure violated the building codes of the state with numerous defects.

Abiodun said several efforts made by the state government to halt further development on site were ignored by the developers.
