Justice J.D. Peters of the National Industrial Court sitting in Ibadan, Oyo State, has fixed hearing in a case filed by an ex-staff of Lead City University, Mr Odeleye Olaleke David, against the institution following the termination of his appointment and failure of the institution to pay his terminal benefits as promised.
Odeleye is asking the court for an order of court mandating Lead City University to pay the sum of N2m as damages and for a court declaration that his purported disengagement from the service of the institution without paying his terminal benefits as specified in the university’s terms and conditions of service is premature, cheating, illegal, unlawful, null and void.
He also asked the court to declare that he is still in the employment of the institution until he is properly disengaged by due compliance with the law regulating his terms and conditions of service with the institution.

He further asked for an order reversing the purported disengagement through a letter dated April 6, 2018 for non compliance with the terms and conditions of service regulating his employment and an order directing Lead City University to pay him the 7.5 per cent staff severance benefit scheme, allowances, arrears of salaries and other entitlements from the date he was employed by the institution in compliance with the terms of agreement and condition of service.
Also, he asked for an order of court directing Lead City University to pay all of his salaries and allowances from May 2018 till October 31, 2018 which were the months that precedes the filing of the suit.
The case was earlier fixed for March 6 but was adjourned when Lead City did not show up at the trial.
The process was supported by a 24-paragraph affidavit deposed to by Odeleye himself.
