A Kano Federal High Court on Friday has dismissed an interim investigation report carried out by Kano state public complaints and anti-corruption commission indicting Emir Muhammad Sanusi II of misappropriation of the Emirate fund as well as recommending his suspension from office
This was just as the Court awarded N200,000 costs against Kano State public complaints and anti-corruption commission.
While delivering its ruling on Friday, Justice Obiorah Egwuatu said the commission was wrong by not availing the Emir the opportunity to defend himself before submitting the report to the government which it said was an infringement on his fundamental rights to a fair hearing.
The Emir of Kano, Muhammadu Sanusi II had filed a suit on 7 June 2019 asking the court to declare that the submission of the commission on the investigation of the emirate finances without according him an opportunity to defend himself was a breach of his fundamental human rights as contained in section 36 of the Constitution and therefore an order of the court quashing the report.
However, Justice Obiorah Egwuatu ,while granting the prayers of the plaintiff in the suit dismissed four grounds of a preliminary objection of the commission saying fair hearing is a fundamental right and in conformity with the principles of natural justice.
The Judge then awarded N200,000 costs against Kano state public complaints and anti-corruption commission.
