Attempted murder: Court dismisses trader for want of diligent prosecution

An FCT High Court sitting in Nyanya, Abuja on Thursday dismissed a case filed against a trader, Charles Agha, accused of the attempted murder of his uncle Darlington, for want of diligent prosecution.

Charles, 51, was arraigned by the police on Nov. 8, 2018, for allegedly attempting to kill his uncle over a piece of land in Abime in Oba, Anambra.

Justice Baba Idris dismissed the suit,  following an application for dismissal of the suit filed by defence counsel, Mr Arinze Ugweke.

Idris said that the continued absence of Urom and Darlington in court warranted the dismissal.

“This development calls for the dismissal of the case,” the judge said.

The defendant’s counsel had prayed the court to dismiss the matter since the prosecutor had continuously not shown up in court nor gave reasons for his absence.

“He (Urom) was in the court at the last adjourned date but today (March 21) no information as per why he was not here,” and urged the court to dismiss the case.

The prosecutor, Mr Augustine Urom said the offence, contravened section 97, 230 and 397 of the Penal Code.

The defendant pleaded not guilty to the charges.
