At the hearing of Arogundade’s appeal on Monday, the court awarded N10,000 cost against Arogundade for delay in compiling and transmitting supplementary record of appeal.
Justice Ahmad Belgore, who is the presiding judge of the division, awarded the cost against Arogundade, also ordered him and his Peoples Democratic Party (PDP) to file a motion to consolidate their appeals.
Justice Fatima Akinbami and Justice Paul Elechi are other members of the panel adjudicating on the House of Assembly appeal case with number CA/EK/76/2017.
The panel had also taken all pending applications were also taken on Monday, while the court also ordered the appellants to file their brief of argument on or before June 19.
The court adjourned the case to June 19 for hearing and adoption of brief of argument.
Arogundade had filed the appeal against the judgment of the Federal High Court, Ado-Ekiti which nullified his election and declared Mr Toyin Obayemi as the validly-elected lawmaker to represent Ado-Ekiti Constituency 1 in the Ekiti Assembly.
The high court had also ordered Arogundade to refund all salaries, allowances and emoluments had received since he was inaugurated as a lawmaker in June 2015.
