The Court of Appeal sitting in Ibadan on Tuesday nullified the appeal filed by the All Progressives Congress (APC) candidate, Olawale Oyetunji Ojeleye against Honourable Akeem Olawale Mustapha of the Peoples Democratic Party (PDP).
The Court panel led by Justice Bada alongside, Justice Ojo and Justice Okonkwo dismissed the appeal on the basis that it lacks merit.
The Court affirmed the victory of the second respondent, Honourable Mustapha as the winner of the election in the Kajola constituency.

Counsel to Mustapha, Tunji Ogunrinde said the victory was for the country as a whole.
“One of the allegations was alleged overvoting in one of the wards of the Kajola constituency and the court held that they did not prove the allegation,” he said adding “this electoral victory was a victory for democracy and the country as a whole.”
In his reaction, Mustapha expressed joy at the outcome of the Appeal Court saying the victory means a lot to him while ascribing it to people of Kajola State Constituency.
“This is a landmark victory for me and the people of the Kajola constituency. It’s a big success.
“My targets now is to focus on my electioneering promises, which is the real assignment given to me by my people. Lawmaking, performing oversight functions and proper representation in the State House of Assembly.
“No more litigation, it is now real work and I promise not to disappoint my people, I hope to justify the confidence reposed in me by God’s grace. I also urge my counterpart from APC to join hands in taking Kajola to greater heights,” Mustapha said.
