The High Court of Justice sitting in Osogbo, Osun State, has scheduled a further hearing for November 1, 2024, in the ongoing case between the Igbajo town Kingmakers and the Osun State Government.
The case challenges the government’s nullification of Oba Adegboyega Famodun III’s selection as the 20th Owa of Igbajo land.
This decision follows the absence of five defence counsels, including those representing Oba Ademola Makinde, the Osun State Government, Boluwaduro Local Government, and warrant chiefs. Their absence prompted the presiding judge, Justice Michael Awe, to express displeasure, warning that if the defendants fail to appear on the next date, the court will proceed with the hearing in their absence.
Dr Saka Layoonu (SAN), counsel to the plaintiffs, criticised the defence’s failure to appear, calling it a disrespect to the court and a deliberate tactic to delay proceedings. He pointed out that this behaviour has been a recurring issue since the case commenced in 2023.
“It is disheartening that none of the five lawyers appeared in court today, showing utter disregard for the court and an attempt to buy time with unnecessary adjournments,” Layoonu stated.
He further emphasised the importance of the case, noting that he had to prioritise his presence in Osogbo over attending the confirmation of newly appointed Senior Advocates of Nigeria (SAN) in Abuja.
The dispute arose following Governor Ademola Adeleke’s nullification of the selection of several traditional rulers upon assuming office in November 2022. Among those affected were the Owa of Igbajo, the Aree of Iree, and the Akinrun of Ikirun, all of whom had been appointed and given the staff of office by the former governor, Alhaji Gboyega Oyetola.
The court will now reconvene on November 1, 2024, with the expectation that the defence will be present to continue the proceedings.
