EIGHT accused persons standing trial before the Onitsha Chief Magistrate Court I, on a three-count charge of conspiracy, attempted murder and murder of one Akachukwu Ezebuilo along Zik’s Avenue, Fegge area of Onitsha are to remain in Onitsha prison custody till Thursday, December 20, 2018, for the report of compliance.
The presiding Chief Magistrate of Onitsha Magisterial District, O. N. Ikeh, after hearing the submissions of the counsel to the complainants, Victor Alo, Augustine Obo and the police Prosecutor on one side, K. K. Oguejiofor, Kenechukwu Kenster and others for defence, refused an oral application for bail made by the defence counsel.
The court, therefore, ordered that the case be binded over, while the file transferred to the Director of Public Prosecutions, DPP for onward transmission to the state Attorney-General and Commissioner for Justice for legal advice.
The accused persons, Chinemelu Onwudinjo, Chinedu Chineke, Chisom Amakaeze, Wilfred Ezeke a.k.a Mgbiligba, Sunday Emenike, Chibuike Onwuka, Chiemezie Ezema and Chibueze Onyeocha, according to the prosecution, had on September 10, 2018, with others now at large, at No. 1 Zik’s Avenue Fegge Onitsha, conspired and murdered Akachukwu Ezebuilo.

In the suit no. MO/973c/2018, the police prosecution had alleged that the accused persons had on the same date and venue, conspired among themselves to commit felony to wit; murder and attempted murder.
The prosecution further alleged that the accused persons had on the same date and venue, allegedly murdered Ezebuilo by firing a gun at him and at the same time hitting him with machetes all over his body, thereby committing offences contrary to sections 495 (a), 274 and 275 of the Criminal Code, Cap 36, Volume II, Revised Laws of Anambra state of Nigeria, 1991.
