JUSTICE Okon Abang of the Federal High Court in Abuja on Thursday has granted leave to the Former Governor of Adamawa State, Murtala Nyako to travel to Germany for treatment.
The judge also ordered that the Chief Register should release the international passport of the former governor and his co-defendant to enable them travel outside the country.
Justice Abang said since the counsel to the Economic and Financial Crimes Commission (EFCC) Rotimi Jacobs (SAN) did not object to the application of the defendants argued by their counsel, John Ochogu, he will grant the defendants leave to travel abroad.
When the matter came up for hearing yesterday, Ochogu said: “My lord we are praying this honourable court to allow the 1st defendant leave to travel to Germany for urgent medical attention.
”While the third defendant, Mr Abba is to travel to the United Kingdom to visit his family”.
Responding to the two applications, prosecution counsel said that he will not oppose to the applications as far as it doesn’t interfere with the proceedings of the court and added that, ”Their sureties should also be informed about the development before travelling out of the country and that the defendants should depose an affidavit to show that they have informed their sureties”
After listening to the application, Justice Abang adjourned till 26th-29th of September for continuation of trial.
Nyako and his son, Abdulaziz Murtala-Nyako, a senator, are standing trial over alleged N40 billion fraud.
They were alleged to have diverted the funds from the Adamawa treasury between January 2011 and December 2014.
