FCT poll: Court confirms Maikalangu as AMAC chairman

The launch, which marks the digital preservation of one of Nigeria’s last remaining sacred groves, is part of Google Arts and Culture’s wider 'Heritage on the Edge' project. The project seeks to support site managers in digitally documenting heritage sites at risk due to climate change, using the imagery captured to further support community maintenance and conservation. The Osun Osogbo Sacred Grove project can be explored via goo.gle/osun-osogbo. Highlights include a 75ha Street View of the Osun Osogbo Sacred Grove, including the Busanyin Shrine before it was affected by the flood and 3D models of four of the site’s dynamic shrines. The collection allows people to view 900 high-resolution photographs of the site, contemporary and historical artworks and sculptures, artists and spiritual leaders. It also tells 28 stories about art, community and spirituality at the Osun Osogbo Sacred Grove, and the effect of climate change at the site and includes three audio interviews, including one with popular artist, Jimoh Buraimoh about Susanne Wenger. The project also allows visitors to watch 27 video interviews and see aerial views and 3D views of the site while annotated 3D tours of the Busanyin and Iya Moopo shrines showcase the legacy of art and spirituality at the sacred grove. “Google Arts and Culture’s mission is to preserve and promote the world’s art and culture online, allowing anyone, anywhere in the world to share in it. We are grateful that through partnerships we are now able to preserve one of the most recognised, culturally rich Yoruba heritage sites, known for active traditional worship and contemporary art movements,” says Chance Coughenour, Program Manager and Digital Archaeologist, Google Arts and Culture. “Through the use of state-of-the-art technologies, site managers will be able to monitor and mitigate the effects of the changing climate and more broadly provide resources to support growing the capacity for the preservation of heritage sites” added Coughenour. Located on the forested banks of the Osun river in the city of Osogbo, in Osun State of Nigeria, the Osun Osogbo Sacred Grove, a UNESCO World Heritage site is several centuries old and among the last sacred groves of their kind which joined the edges of most Yoruba cities before the mass shift from rural to urban areas. In the site, Yoruba deities are embodied in shapely, sculpted shrines where creativity and spirituality come to life. Recently, the Grove has been in danger of destruction due to flooding, heavy rain and climate change. The Busanyin shrine was damaged in floods shortly after being digitally captured. “The Yoruba community is one of the largest in Nigeria and the Osun Osogbo Sacred Grove is truly a unique and special place that embodies the essence of the Yoruba culture and heritage. We are excited about the digital preservation of the site and the partnership with Google Arts and Culture. It offers a noteworthy body of work that portrays the admirable culture of the Yoruba people to the world,” Olufemi A. Akinsanya Akinsanya, Chair, Save Our Art! Save Our Heritage! Campaign said. “CyArk's work in Osogbo has been a true collaboration between Nigerian government officials, local NGOs, the community of Osogbo, and His Royal Highness Jimoh Oyetunji Olanipekun Larooye II, who are all working together to share the stories of Osogbo with a wider audience,” said Kacey Hadick, Director of Programs and Development, CyArk. Alhaji Lai Mohammed, Honourable Minister of Information and Culture, Federal Republic of Nigeria, added, "I am truly delighted that, for the first time ever, the Osun Osogbo Grove has been brought online, thanks to Google Arts and Culture, which has partnered with CyArk and the Adunni Olorisa Trust/Osun Foundation to digitise the shrine and its surroundings, thus protecting both for posterity. “I said during the visit to the Grove in 2019 that it was important to refocus national and global attention on this world heritage site, and I am glad we achieved our purpose, as can be attested to by this project digitising the shrine and its surroundings. I wish to most sincerely commend all the partners for this monumental work,” Alhaji Lai Mohammed said. Through past projects like Taste of Nigeria and Eko for Show, Google Arts and Culture has helped people across the world experience Nigeria heritage and history. The Peoples Democratic Party (PDP) has won in the Federal Capital Territory, as the FCT Area Council Election Appeal Tribunal has upheld the election of Hon Christopher Maikalangu as Chairman of Abuja Municipal Area Council (AMAC).

In a unanimous judgement, the three-man tribunal, including Hon Justice S. B Belgore (Chairman), Hon Justice Yusuf Halilu (member 1), Hon Justice Jude O. Onwuegbuzie (member 2) dismissed the August 5 judgment of the FCT Area Council Election Tribunal, which declared Hon. Murtala Usman Karshi of the All Progressives Congress (APC) as the winner of the election held on February 12.

The justices said that the judgement of the lower tribunal was not only evil but negates all the achievements recorded in Nigeria’s democracy.

Recall that Tribune Online had reported in August how the election tribunal sitting in Abuja on Friday to look into the February 12 election in which Hon Christopher Zakka Maikalangu won the election with a total vote of 19,302 votes while Mr Usman Karshi secured 13,249 votes, granted over 21000 votes to PDP’s challenger Mr Murtala Karshi of the APC, with the current AMAC Chairman Zakka still maintaining 19000 votes, making Murtala Karshi the valid Chairman of AMAC in the process, and Maikalangu went ahead to appeal the verdict.

While reading out the lead judgment in suit FCT/ACEAT/AP/01/22, which had Christopher Maikalangu as appellant and Murtala Karshi and three others as respondent, Hon. Justice Yusuf Halilu said that the lower tribunal erred by ignoring contradictory evidence before it and went ahead to do a hatchet job by declaring Karshi the winner of the election.

“It is not in doubt the APC as a party was faced with legal battles after the party primaries to nominate a flagship bearer for the AMAC election held on 12th February 2022. It is equally not in doubt that the 1st respondent, Murtala Usman Karshi, was involved in the said altercation, which eventually landed parties before the apex court of this land i.e Supreme Court of Nigeria, which eventually declared the 1st respondent as the winner of the APC primary for AMAC election.

“We have seen the evidence supplied by both the appellant and the respondents to the lower tribunal. The witnesses listed by the APC as supervisors in the disputed polling units admitted that they were not polling unit agents. It has become critical for us to ask questions at this point on what the process of collating results connotes.

“Can collation be done without polling units results? It is indeed a process of an election that votes are cast at polling units, results collated by electoral officers and results announced to the hearing of all. If that is the case, who then is the proper person to be called in the event that there is a complaint anchored on wrongful collation of results? Is it the ward supervisor or a polling unit agent? The answer is a polling unit agent.

“The evidence of the supposed polling unit agents, who were not at the disputed units, falls within the evidence of hearsay or documentary hearsay, which arises when someone who is not privy to the origin of a document seeks to prove its content by the oral documentary.

“On the evidence of our findings that the aforementioned witnesses were not the polling unit agents in the affected polling units, the evidence of the witnesses, as entertained by the lower tribunal, are hereby expunged. In the same vein, all said documents that were made references to by the said witnesses have been dumped by the tribunal as no evidence could have led to their content.

“Despite the disparity in evidence of the witnesses, the tribunal decided to do a hatchet job by trying to throw the baby away with the bath water. What is good for the goose is also good for the gander. The tribunal clearly had two rules up its sleeves: one for the petitioner, another for the respondent. The tribunal had the opportunity to compare the forms tendered by the respondents, but that was not to be.


“The petitioner failed woefully to prove its claim, arising from what was made at the lower tribunal. Elections are won at polling units and not at law courts. Our duty as court is to make judicial pronouncement. The law cannot command an impossibility. The essence of justice is to do what is true and what is correct. INEC official certified the forms used in the election, you can then ask where the petitioner got his own form. This is for another day.

“He who passively accepts evil is much involved in it as he who perpetrates it. Clearly, the evidence of the petitioner is in limbo as a judicial gatecrasher. We say no more to evil. Therefore, appeal FCT/ACEAT/AP/01/22 subsides. The judgment of the lower tribunal delivered on 5th day of August 2022 is hereby set aside. All declarations so made by the lower tribunal is hereby set aside.

“The declaration of INEC that Christopher Zakka of the PDP is the duly elected chairman of AMAC is hereby restored. May God help us,” the court confirmed.

Addressing journalists after the judgement, AMAC Chairman, Christopher Zakka Maikalangu, said the judiciary is the last hope of the common man, thanking the tribunal for defending democracy.

“I am the happiest person on earth today. I have not rested since I won the election in February. Every day, it has been going to the tribunal. From tenure elongation to this present case. But today, we are smiling because the tribunal has restored democracy. I thank God for using the judiciary to restore democracy.

“Let me pass this message to people out there. The richest man in Africa, Alhaji Aliko Dangote, is not known for taking people to court with all his money. People here in the FCT, because God blessed you with money, all you know is dragging people to court. If you want to contest, go and ask people to vote for you. Don’t think that the judiciary is where you can go and win elections. The judiciary is for the common man. So, I thank the judiciary for restoring democracy, for standing with the common people. I thank God the whole thing has ended,” He stated.
