Justice Yusuf Halilu of the High Court of the Federal Capital Territory (FCT), sitting at Maitama, Abuja, on Friday dismissed the suit filed by the Economic and Financial Crimes Commission (EFCC) against a former Governor of Imo State, Owelle Rochas Okorocha.
The anti-graft agency had charged the former governor before the court with allegations bordering on fraud allegedly committed during his tenure as Imo state governor.
Delivering judgment in the matter, Justice Halilu held that an order made by a court of competent jurisdiction is valid until it is set aside.
According to him, EFCC ought to have appealed the judgment of the Federal High Court, Abuja, holding that the pronouncement made by the court and that of the Federal High Court, Port Harcourt, remains law.
He subsequently held that the suit filed by the EFCC before the court is an abuse of the court process.
“The charges before the court are consequently dismissed for being an abuse of the court process,” Justice Halilu held.
