The Court of Appeal sitting in Abuja, has struck out the appeal brought before it by Hon James Faleke, challenging the judgement of the Kogi State Governorship Election Petition Tribunal which threw out his petition and affirmed Yahaya Bello as the duly elected governor of the state.
The five-member panel of justices of the appellate court said Falake has no right in law to challenge Bello’s election, who is a member of same party with him, the All Progressives Congress (APC).
The court also held that Faleke failed to prove the allegations stated in his petition and held that, “all the issues raised by the appelant are resolved against him, the appeal fails and it is accordingly dismissed.”
The court then upheld the judgement of the Kogi State Governorship Election Petition Tribunal.
Judgement in the appeal by the immediate past governor of the state, Capt Idris Wada just commenced.
